TERMS AND CONDITIONS OF SALE

Article 1 — Seller Identity and Scope of Application
These Terms and Conditions of Sale (hereinafter the “Terms”) govern the sale of jewellery marketed under the brand BARETT, in particular through the website www.barett.eu.

Hereinafter referred to as “BARETT” or the “Seller”.
These Terms apply to any order placed by a natural person acting for purposes outside their trade, business, craft or profession, hereinafter referred to as the “Customer”.
Placing an order implies prior review and acceptance of these Terms.
BARETT reserves the right to amend these Terms at any time. The terms applicable to an order are those in force at the time the Customer confirms the order.
Article 2 — BARETT Jewellery
BARETT offers a collection of jewellery made in particular from 18-carat gold and, depending on the design, set with diamonds and/or other stones.
The essential characteristics of each item of jewellery, in particular the materials used and, where relevant, the characteristics of the stones, are indicated on the relevant product page on www.barett.eu.
BARETT takes the utmost care in presenting and describing its creations. However, the photographs, videos, visuals and other representations of the jewellery are provided for illustrative purposes only.
Due in particular to the specific characteristics of stones and materials, the manufacturing process, and screen display settings, slight variations in colour, shade, appearance, weight or dimensions may exist between the photographs shown on the website and the jewellery delivered.
Such variations, which are inherent to the materials used and the manufacturing process, do not, on their own, constitute a lack of conformity.
Article 3 — Availability
Jewellery is offered for sale subject to available stock or, where indicated on the product page, is made to order.
In the exceptional event that an item of jewellery becomes unavailable after the order has been confirmed, BARETT will inform the Customer as soon as possible.
Depending on the circumstances, the Customer may accept a new delivery time, choose a different item of jewellery where possible, or request the cancellation and refund of their order.
Article 4 — Price
The prices shown on www.barett.eu are indicated in euros (€), inclusive of all taxes, unless otherwise stated.
Any delivery charges are shown separately to the Customer before final confirmation of the order.
BARETT reserves the right to change its prices at any time. The price applicable to an order is the price displayed at the time the order is confirmed.
All orders are payable in euros.
For deliveries outside the European Union, customs duties, import taxes or other taxes or charges may be levied by the authorities of the destination country.
Unless otherwise stated when the order is placed, such duties, taxes and charges are not included in the price paid to BARETT and remain payable by the Customer.
Article 5 — Orders
To place an order on www.barett.eu, the Customer selects the desired item(s) of jewellery and adds them to their basket.
Before finally confirming the order, the Customer has the opportunity to check the items selected, the total order price, any additional charges and the information provided, and to correct any errors.
Final confirmation of the order implies acceptance of these Terms and the obligation to pay.
An order confirmation is sent to the Customer by email once the order has been confirmed.
The Customer is responsible for the accuracy of the information provided when placing the order, in particular the delivery address.
BARETT reserves the right to refuse or cancel an order for a legitimate reason, in particular in the event of suspected fraud or a prior dispute relating to payment for an order.
Article 6 — Payment
Payment is made using the payment methods offered on www.barett.eu at the time of the order.
Transactions are processed through the secure payment providers offered on the website.
BARETT does not retain the Customer’s full banking details.
The order is considered final only once payment, or authorisation of payment, has been confirmed by the relevant payment provider.
Where BARETT offers instalment payment, the specific terms of the relevant payment provider also apply.
The jewellery remains the property of BARETT until the price has been paid in full.
Article 7 — Delivery
Jewellery is delivered to the address provided by the Customer when placing the order.
The countries and areas to which BARETT delivers are indicated on www.barett.eu at the time of the order.
The applicable delivery charges and times are communicated to the Customer before final confirmation of the order.
Where the item of jewellery is made, personalised or adjusted to order, any manufacturing time is communicated to the Customer and is in addition to the shipping time.
BARETT uses its best efforts to meet the delivery times announced.
The risk of loss of or damage to the jewellery passes to the Customer when the Customer, or a third party designated by the Customer other than the carrier, takes physical possession of the parcel.
Upon receipt, the Customer is invited to check the condition of the parcel and the jewellery and to report to BARETT as soon as possible any anomaly, damage or suspicion that the parcel has been opened.
Article 8 — Right of Withdrawal
In accordance with the legal provisions applicable to distance contracts, the consumer Customer generally has a period of 14 calendar days from the day after receipt of the jewellery in which to exercise their right of withdrawal, without having to justify their decision.
To exercise this right, the Customer must inform BARETT of their decision to withdraw by means of a clear statement sent to:
or by using the withdrawal form made available on the website.
The Customer then has the applicable statutory period to return the jewellery in accordance with the instructions provided by BARETT.
The jewellery must be returned with its packaging, accessories and, where applicable, the documents and certificates that accompanied it.
The Customer is liable for any diminished value of the jewellery resulting from handling other than what is necessary to establish its nature and characteristics.
Unless BARETT indicates otherwise, the direct cost of returning the jewellery is borne by the Customer.
Given the nature and value of BARETT jewellery, it is strongly recommended that any return be made using a shipping method that is secure, trackable and insured for the full value of the item.
BARETT will issue the refund in accordance with the timeframe and terms provided for by applicable law, generally using the same payment method as that used for the order, unless otherwise agreed.
Article 9 — Personalised Jewellery and Exceptions to the Right of Withdrawal
In accordance with applicable law, the right of withdrawal does not apply, in particular, to goods made to the consumer’s specifications or clearly personalised.
This exception may apply, in particular, to an item of jewellery made specially at the Customer’s request with personalised features that are not among the standard options offered by BARETT.
Where this exception applies, the Customer is clearly informed of this before confirming their order.
Simply opening the packaging or reasonably trying on a standard item of jewellery does not automatically remove the right of withdrawal.
Article 10 — Returns, Authenticity and Inspection of Jewellery
Before making any return, the Customer is invited to contact BARETT at info@barett.eu to receive practical instructions for the return.
The jewellery must be carefully protected and packaged for transport.
The Customer must keep proof of shipment.
Given the nature and value of BARETT jewellery, any item returned may be subject to a thorough inspection of its condition, conformity and authenticity before the refund is approved.
This inspection may cover, in particular:
- the overall integrity of the item;
- its weight;
- its condition;
- its setting;
- the nature and characteristics of the diamonds and other stones;
- the authenticity of the stones;
- any certificates, inscriptions, engravings or identification numbers associated with the item or its stones.
BARETT may compare the returned item with the information, characteristics, photographs, documents or other reference records it holds concerning the item at the time it was shipped.
Any substitution of a stone, in particular its replacement with a lab-grown, synthetic or treated stone, or with a stone of a different nature, origin or characteristics from those of the stone originally set on the item, as well as any unsetting, resetting, alteration, modification or other intervention carried out on the item after delivery, may result in the refund being refused in whole or in part, to the extent permitted by applicable law.
In such a situation, BARETT also reserves the right to exercise any remedy available to it under applicable law.
However, the inspection and return arrangements set out in this article may not have the effect of depriving the consumer of their statutory rights.
Article 11 — Statutory Warranty of Conformity
BARETT jewellery benefits from the statutory warranty of conformity applicable to consumer goods.
For sales concluded with a consumer, this warranty covers defects of conformity in accordance with applicable Belgian law, in particular for the statutory period of two years from delivery of the item.
In the event of a problem, the Customer is invited to contact BARETT at info@barett.eu, describing precisely the defect observed and, if possible, attaching photographs.
The statutory warranty does not cover damage that does not result from a lack of conformity.
This may include, in particular, damage resulting from:
- an accident, impact or fall;
- misuse of the item;
- lack of maintenance;
- normal wear and tear from wearing the item;
- inappropriate handling;
- or any external intervention causing the damage.
Jewellery items are precious and delicate objects. Prongs, settings, clasps and other components may, in particular, be affected by impacts, snagging or inappropriate use.
A repair, alteration, resizing or other intervention carried out by a third party may be taken into account where it is the cause of the defect or damage claimed.
No provision of these Terms may have the effect of limiting or removing the mandatory rights granted to the consumer under applicable law.
Article 12 — Care and Use of Jewellery
To preserve the beauty and integrity of BARETT jewellery, it is recommended that items be handled with care.
It is advisable, in particular, to avoid significant impacts and to remove jewellery during activities that could damage it.
Normal wear and tear from wearing an item does not, in itself, constitute a lack of conformity.
BARETT may offer, depending on the case, maintenance, inspection or repair services.
Where such services are chargeable, their price or a quote is provided to the Customer before the work is carried out.
Article 13 — Intellectual Property
The BARETT trademark, as well as BARETT’s creations, in particular their designs, shapes, forms, compositions, graphic elements and original aesthetic features, are protected, where applicable, by the applicable intellectual property rights.
The photographs, videos, text, graphics, logos, visuals and, more generally, the content on www.barett.eu are also protected by the applicable intellectual property rights.
Except with BARETT’s prior written authorisation, any reproduction, representation, adaptation, manufacture, marketing, distribution or exploitation, in whole or in part, of BARETT’s creations or content is prohibited to the extent provided for by law.
BARETT reserves the right to take action to protect its creations, its trademark and its intellectual property rights against any unauthorised use.
BARETT respects the intellectual property rights of third parties.
However, no provision of these Terms shall be construed as granting BARETT any rights over elements legitimately belonging to third parties.
Article 14 — Personal Data
In the course of its activities and the operation of www.barett.eu, BARETT collects and processes certain personal data relating to its Customers.
This processing is carried out in accordance with applicable data protection law, in particular the General Data Protection Regulation (GDPR).
Information about the data collected, the purposes of its processing, its retention and the rights of data subjects is set out in detail in the Privacy Policy available on www.barett.eu.
Article 15 — Force Majeure
BARETT cannot be held liable for any delay or failure to perform its obligations resulting from an event beyond its control that meets the conditions for force majeure under applicable law.
Where such an event is likely to affect the fulfilment of an order, BARETT will inform the Customer as soon as possible.
Article 16 — Complaints and Customer Service
For any question or complaint regarding an order, a delivery or an item of jewellery, the Customer may contact BARETT at:
BARETT will endeavour to handle the request as soon as possible and, in the event of a dispute, to seek an amicable solution with the Customer.
Article 17 — Dispute Resolution and Applicable Law
These Terms are governed by Belgian law, subject to any mandatory provisions applicable to the consumer by reason of their country of residence.
In the event of a dispute, the Customer is invited to first contact BARETT to seek an amicable solution.
Where the legal conditions are met, the consumer may also refer the matter to a competent body for the out-of-court settlement of consumer disputes.
Failing an amicable settlement, the dispute will be submitted to the competent courts in accordance with the applicable legal rules.
